In September 2021, the Permanent Residence Online Application Portal was implemented by Immigration, Refugees and Citizenship Canada (IRCC). This tool allows authorized immigration representatives to submit permanent residence applications online on behalf of their clients. It aims to avoid the risks of losing application documents and to maintain responsive communication with the Government of Canada. Now the big challenge is to choose the right service provider among the many experts in immigration for the purpose of submitting your application on your behalf via this platform because immigrating is a big decision in life for your family. Some questions need to be clarified to find out how to use a representative:
Who are the authorized representatives for immigration matters?
According to Immigration, Refugees and Citizenship Canada (IRCC), the representatives could be: lawyers or immigration consultants, friends, family members or other third parties.
They are divided into two types: paid and unpaid.
Unpaid representatives could be: family members, friends and other third parties who do not charge a fee.
The paid representatives are people you pay and authorize to represent, advise and consult you in your immigration process. They must be:
lawyers who are members in good standing of a Canadian provincial or territorial law society;
notaries who are members in good standing of the Chambre of Notaries of Quebec;
immigration consultants who are members in good standing of the Immigration Consultants of Canada Regulatory Council.
How to choose the best one?
Canada is often seen as a “country of immigrants”. For over a century, immigration has been a means to support population, economic and cultural growth in the country. In this way, there’s a variety of Canadian immigration programs such as Investor, Entrepreneur, Self-Employed, Start-up, Federal Skilled Worker, Family Class and Refugee Class. Most of Canada’s provinces and territories operate their own PNP program to nominate candidates for immigration to Canada.
The more immigration streams there are, the more complex the Canadian immigration laws can be. Their processes can be stressful and confusing. Errors and omissions can cause significant delays, higher costs and refusals. Hiring a representative is not required but it is very important for applicants if they are outside Canada.
In this context, it is important to use a paid representative to help you with your Canadian immigration application and to make sure they are authorized in order to protect yourself from becoming a victim of immigration fraud.
Priority should be given to service providers with many years of experience, an extensive network of partners as well as a team of lawyers with broad and dedicated professional knowledge.
Why should you speak with an immigration lawyer?
Immigration lawyers must attend highly-competitive law schools which typically first involve completing an undergraduate degree before their three-year Law degree. Then, they are required to pass the bar exam in order to register as a lawyer and undergo an internship period with a law firm during or after their studies. The client could benefit from years of education and specialized training dedicated to immigration law.
Immigration lawyers are professionally licensed and regulated by provincial or territorial law societies. They must adhere to strict rules and follow ethical standards. For example, your communications with them will be kept private by rules of confidentiality. If they are not, lawyers are subject to disciplinary action.
Being a good immigration lawyer goes further than just knowing the immigration rules and regulations of a specific country. The lawyers should also have a deep cultural knowledge not only about the country they are practicing in but also the practice in the country of origin of their client.
