Workshop: New Regulations On Managing Foreign Labor In Vietnam (8:00 am)

Vietnam, ranking among the fastest-growing economies in the world, attracts more and more foreign labor to come to work or look for business opportunities. However, the regulations on issuing work permit in Vietnam require a lot of conditions, process and procedures which make the implementation and foreign labor management in Vietnam more complex.

Recently, the Government has issued Decree 11/2016/NĐ-CP dated on Feb 03rd, 2016 with detailed regulations on the implementation of the Labor Code on issuance of work permits to foreign workers in Viet Nam (valid from April 01st, 2016) & Circular No. 40/2016/TT-BLDTBXH of the Ministry of Labor, War Invalids and Social Affairs dated October  25, 2016 guiding on implementation of a number of articles of Decree No. 11/2016/ND-CP detailing a number of articles of the labor code in respect of foreign workers in Vietnam (valid from Dec 12th, 2016) with some new important points in managing foreign labor working in Vietnam.

In order to help enterprises keep the changes of new regulations and provide the detailed guidance on process, procedures and documents on issuance of work permits to foreign labor in Vietnam in 2017, NVM Group organizes a workshop: “New Regulations on Managing Foreign Labor in Vietnam” on March 17th, 2016 at Grand Saigon Hotel.

On 24 Feb 2017, the Vietnamese government released transfer pricing (TP) decree No. 20/2017/ND-CP: “Providing tax administration applicable to enterprises having controlled transactions” (“Decree 20”), which will take effect from 1 May 2017. There are many changes related to tax administration for enterprises in the Decree but the highlight is new rule on transfer pricing (TP).


The Decree provides new transfer pricing compliance requirements, including three-tiered TP documentation, new TP declaration forms, guidance on the deductibility of related party expenses, and interest deductibility, all of which are substantial changes to existing rules.


It is believed that the Decree No.20 represents the most important development of the transfer pricing regime in Vietnam for the last ten years and it is critical for foreign companies investing into Vietnam to be aware of these new rules.
